Writ seeking declaration of interim government as 'revolutionary government', hearing tomorrow

The High Court has fixed Monday for hearing on the writ petition seeking necessary directions to declare the interim government led by Professor Dr. Muhammad Yunus as a 'revolutionary government'.

On Sunday (October 27), a High Court bench comprising Justice Farah Mahbub and Justice Debashish Roy Chowdhury fixed the hearing date.

In the writ petition filed last week, freedom fighter Mofazzal Hossain, a resident of Narayanpara in Raninagar, Naogaon, said that according to the constitution, if the parliament is dissolved, national elections must be held within the next 90 days. The parliament has already been dissolved. Articles 57 and 58 of the constitution specify the term of office of the Prime Minister and other ministers and according to these two articles, they must remain in office until the next government takes office.

The petitioner said that if elections are not held within 90 days, Article 123 (3) (b) of the constitution will be violated. For this violation, the existing law provides for the maximum punishment for treason and other crimes under Article 7(a) of the Constitution. Therefore, the petitioner said that the current government needs to be declared a revolutionary government to avoid violating the Constitution.
